With a recurring dues membership, you are agreeing to pay for your Pilates Social Clemson membership on a recurring dues basis. You will be charged monthly for your membership for the duration of your contract. Your fixed term membership will auto renew at the end of your contract (membership agreement) unless you provide notification, in writing, 60 days prior to the auto renewal date.

Recurring dues memberships can only be cancelled during a contract, with limited exceptions as described below. Even if you meet one of the limited exceptions during your initial term, you will be charged a $150 early termination fee. You expressly give Pilates Social Clemson, LLC., or its authorized billing agent, the right to bill you for any dues, late charges, and fees associated with your obligation per this membership agreement.

Your payment schedule date will be the same date as the first day of your agreement with Pilates Social Clemson, LLC. each month.

There is a replacement card fee of $25, a no-show fee of $15, and a failure to give notice of no-show fee of $15, in addition to using one of your class credits. Failure to pay your monthly recurring membership dues is subject to a $25 charge per month late fee. There is a $25 per returned item charge. You expressly give Pilates Social Clemson, LLC., or its authorized billing agent, the right to bill you for any of these dues, late charges, and fees associated with these provisions of this agreement.

Membership to begin on : 11/22/2024.

Card to be charged today : 11/22/2024.

After the initial charge, your card will be charged on the same date each month, starting in September 2024.  Pilates Social Clemson to open on or about August 17, 2024. In the event the opening is delayed, your card will not be billed a second time until 30 days into the commencement of the studio.

I understand this is a recurring dues membership. 

Term of contract: One year

Grip socks must be worn during all classes.

Window to use single class or class credit bundle begins today 11/22/2024 or the first day in which the studio opens, whichever date comes later.

Term: Single classes must be used within 30 days, 4 packs within 60 days, 8 packs within 90 days, and 12 packs within 90 days.

I Understand this is a one-time purchase of a single class or bundle of class credits.

Grip socks must be worn during all classes.

For recurring membership:  I understand that my membership will continue to renew monthly until I properly cancel my membership. To properly cancel, I must provide Pilates Social Clemson with a 30-day advance written notice of cancellation. I will still be expected to pay all dues, fees, and charges associated with my contract and account. I understand that my agreement is for a fixed initial term and that unless I provide Pilates Social Clemson with a written notice of cancellation at least 30 days prior to the end of my initial term, my membership will automatically roll over to a month-to-month agreement. I will then be able to cancel at any time with a 30-day advance written notice. Once I give proper 30-days-notice to cancel a month-to-month, I will continue to pay Pilates Social Clemson the dues, fees, and other charges on my account in the amount of the agreed contractual amount as per this contract per month, subject to all other terms of this agreement.

Rescission cancellation, policies, and refunds:

Rescission Law (your rights under the law):  You may resend this agreement at any time prior to midnight of the third business day after the date of this agreement to resend this agreement. You just have to mail (postmarked and certified) or hand-deliver assigned and dated notice which states that you were rescheduling, resending, or canceling this agreement and send to the address for Pilates Social Clemson at the top of this agreement (cancellation).

Cancellation of Agreement (limited exceptions to no cancellation of contract policy): After the expiration of the three-day rescission period, you may cancel this agreement only if you qualify. It only applies if you become disabled or die. If reason of death or permanent disability, you are unable to receive all services for which you contracted, then you or your estate may cancel this agreement without penalty and receive a prorated refund from the effective, applicable date of disability onset or loss. Pilates Social Clemson reserves the right to ask for a disability to be verified by a physician.

Rules, regulations, and schedules: All Pilates Social Clemson members and their guests must abide by the rules, regulations, and schedules of Pilates Social Clemson, which may be posted at the studio, or can be issued orally and which may be amended from time to time at Pilates Social Clemson. Upon joining you must pay the appropriate initial charges for Pilates Social Clemson. At the discretion of any Pilates Social Clemson representative, your membership may be revoked or suspended at any time if in the judgment of Pilates Social Clemson, you or your guest fail to observe the rules and regulations, or if you have otherwise behaved in a manner contrary to the best interest of Pilates Social Clemson’s members or employees, or if you have instituted any type of legal action against Pilates Social Clemson, including but not limited to civil actions, arbitration, and or mediations and/or if Pilates Social Clemson has instituted any type of legal action, including, but not limited to civil actions, arbitrations, and or, mediations against you.

Termination of recurring dues memberships: If you are a month-to-month member following an auto renewal of a contract, you may terminate this agreement at any time by providing Pilates Social Clemson with a 30-day advanced written notice sent via certified mail. There is no early termination fee for a month-to-month membership after the duration of the initial term of a contract when it auto renews month-to-month. You may still cancel your membership with a 30-day advance written notice, but you will require to pay $150 termination fee.

You will receive a refund if you properly rescind your membership. Pilates Social Clemson will turn off the auto renew payments on your account, and you will not be charged a penalty or early termination fee. Any refund due of any kind will be paid to you within 30-days under this agreement. Notice to rescind or cancel may be delivered in person to the studio or be sent via certified mail to Pilates Social Clemson at the address at the top of this contract.

Release of Liability, Assumption of Risk, Indemnity: Using this studio owned by Pilates Social Clemson, LLC. involves the risk of injury to you or your guest whether you or someone else causes it. Specific risks vary from one activity to another and the range from minor injuries to major injuries, such as a catastrophic injury, including death. In consideration of your participation in the activities offered by Pilates Social Clemson, you understand and voluntarily accept this risk and release Pilates Social Clemson, and its respective owners, founders, officers, directors, employees, volunteers, agents, and independent contractors (he “releases”) from all liability for any and all injury, including without limitation, personal injury or mental injury, economic loss, or any damage to you, your spouse, guest unborn child relatives, resulting from your use of Pilates Social Clemson, including any injury relating to the ordinary or gross negligence, actual or passive, of the releases of anyone acting on the releases behalf or anyone using your Pilates Social Clemson studio or premises related to exercise or not.

If your Pilates Social Clemson location closes or relocates: If Pilates Social Clemson, where you have a membership closes, and Pilates Social Clemson cannot offer your services at an alternate Pilates Social Clemson facility located with 30 miles from your original location, you may cancel this agreement without penalty and receive a prorated refund for any prepaid amounts.

Activities: You agree to indemnify, defend, and hold the releases harmless, against any liability, damages, defense costs, including attorneys’ fees, and other costs incurred in connection with claims for bodily injury, wrongful death, or property damage caused by your negligence or other acts of omissions. You further agree to hold harmless to and indemnify the releases from all liability, damages, defense costs.

Buyer’s rights: South Carolina does not have a statute regulating health clubs. Please be aware that if you choose to pay for any part of this agreement in advance, you are paying for future services, you may be risking loss of funds in the event this health club stops conducting business. Health clubs in this state do not post a bond, and there may be no other protections provided to you should you choose to pay in advance. 

Medical conditions: Before using Pilates Social Clemson services, facilities, or premises, you represent that you are in good health and have no disability, impairment, injury, disease, or ailment preventing you from engaging in active or passive exercise which could cause increased risk of injury or adverse health consequences as a result of exercise. You assume full responsibility for your use of Pilates Social Clemson’s facility and shall indemnify Pilates Social Clemson, its affiliates, agents, and employees (and all “releases”) against any and all damages arising out of your use of the facilities.

Limitations: Unavailability of classes is to be expected and there may be occasional delays, especially during peak hours and using the fitness equipment, or you may not always be able to attend most sought-after times for exercise classes. All members should schedule their desired classes in advance, by going on the Pilates Social Clemson schedule or contact Pilates Social Clemson’s studio directly to schedule class.

Freeze Policy: If you are temporarily unable to use the Pilates Social Clemson studio for medical reasons, you may request a freeze of your membership and monthly payments. You are required to provide a written request asking for a freeze. Ask for a freeze form and return it to the general manager or owner of Pilates Social Clemson. You acknowledge and understand that freezing your membership will extend the term of your agreement and that you’ll be obligated to pay your monthly dues as per your original agreement until the minimum term has expired. A fee of $60 per month will be assessed for freezing a membership. Pilates Social Clemson reserves the right to adjust this freezes policy from time to time as its sole discretion.  A request to freeze must be received 30 days in advance. Retroactive freezes will not be accepted. There is a limit of two freeze months per contract term.

Client Release Form

1. Pilates Social Clemson is not liable for any injury, physical or emotional, sustained while on the premises of 101 McCollum Street, Clemson, SC, 29631.
2. Client must inform instructor prior to lesson of any physical, mental, or medical changes.
3. 12-hour notice is required for cancellation, or full payment is required.
4. There is no refund for any unused credits each month.
5. A NO SHOW FEE of $15 applies if 12-hour notice was not received, in addition to monthly fees. NO EXCEPTIONS FOR ANY REASON. This will be strictly enforced.
6. Client must arrive on time for their class. If the client is 10 or more minutes late, the credit will be forfeited and paid in full.
7. Pilates Social Clemson, LLC is not responsible for lost or stolen items.
8. It is the client's responsibility to know his or her credit balance.
9. Client is to be respectful of other clients coming and going and respect the other client's time and lesson by arriving and departing quietly.
10. Failure to comply to any of these requests is an automatic forfeit of a class credit.
11. Instructor reserves the right to end the lesson at any time if it is in the best interest of the client or other clients in the class.
12. Client may be removed from the studio by the instructor at any time.
13. Client shall not consume alcohol or drugs prior or during session. Instructor will be informed of any prescription drugs taken prior to the lesson and the instructor reserves the right to end the lesson.
14. All students must wear grip socks to class. NO EXCEPTIONS CAN BE MADE. If you forget a pair of grips socks, they will be available for purchase at the studio (while supplies last).
15. All students must wipe down their equipment after class with the sanitary wipes provided by Pilates Social Clemson, LLC.
